1. Terms of Agreement
(a) By booking and attending a training with The Mindfulish School, whether it be in-person or online, you are agreeing to comply with and be bound by the following terms and conditions.
(b) The term ‘The Mindfulish School’ or ‘TMS’ or’ ‘us’ or ‘we’ refers to the owner(s) of the company and its teachers. The term ‘you’ or ‘I’ refers to the student or guest or user or viewer of our website and/or services. The terms ‘retreat’ or ‘program’ or ‘workshop’ or ‘classes’ or ‘services’ or ‘training’ refers to all aspects of the services on offer, to include, but not be limited to, the classes, accommodation, material, and activities.
2. Booking & Payment Procedure
(a) On making a booking with us, each person accepts the terms of these booking conditions.
(b) We ensure that the trainings are supplied as described and that the services we are contractually obliged to provide are to a reasonable standard.
(c) Your place is not confirmed until the deposit payment has been received. A request for the remaining balance will be issued and will need to be paid 45 days before the training start date. If the balance price of your payment is not paid in time and you have not made other payment arrangements with us, we reserve the right to cancel your retreat and retain your deposit plus what has been paid. 90 days from retreat start, 50% of the total payment must be paid. 45 days from the retreat start date, the full balance must be paid.
(d) If making your booking within 45 days from the retreat start date, the full balance will be due.
(e) Tickets are non-transferable. A refund will only be issued if the training is fully booked. A refund in this case is minus the deposit. Any monies owed in this case will be paid to you one month after the retreat end date.
(f) We reserve the right to increase the price of the training before you submit your booking. Any price change will be displayed on the WeTravel platform before you book the retreat.
(g) We reserve the right to reduce the price of the retreat or run special offers at any time. Once you have made your booking and paid your deposit these price changes will not apply to you.
(h) Membership discounts with classes do not apply to retreats as stated in your membership terms and conditions.
(i) Where a group booking is made on behalf of several individuals the booking is conditional on the person(s) paying to have authorization from all the individuals named on the booking form to enter into this contract. The terms of this contract will apply to each member of the group as though they had paid for their retreat individually and directly to us.
(j) Optional trips, excursions, and treatments booked locally are not our responsibility and are at your own risk and cost.
(k) Participants are responsible for all nights and rates reserved. Because this is an all-inclusive training, refunds and pro-rating are not possible.
(l) The price is the exact amount to be received by TMS in US Dollars.
(m) Payment Plans are available per request.
3. Cancellation Policy and COVID-19
(a) You (or any member of your party) may cancel your booking at any time, provided that the cancellation is made by the person submitting the booking form and is notified to us in writing. Cancellation will take effect the day such notification is received by us.
(b) Deposits are non-refundable.
(c) If cancellation occurs 90 days before the first day of the training, you will receive a refund of all additional payments minus the deposit. If cancellation occurs 30-90 days before the first day of the training you will receive a 50% refund minus the deposit. The other 50% is non-refundable. If cancellation occurs 45 days or less from the first day of the training you will not receive any refund. Once the training has commenced, no refund or part refund or unused portion of your retreat will be repaid in the event of cancellation by you.
(d) If the training is canceled by either party, there will be no refund or compensation available from us for your flight costs, loss of work, transfers, and other associated costs. For this reason, we strongly recommend that you purchase travel insurance and ensure such events are covered by your provider.
(e) While we have never canceled a retreat to date, we reserve the right in any circumstances to cancel the retreat, you may transfer your full retreat payment to another retreat, or you may request a refund of your payment to us, constituting a full settlement (unless the reason for cancellation is force majeure, see clause 3(f)).
(f) Compensation will not be paid if we are forced to cancel or in any way change your holiday due to war, the threat of war, invasion, riot, civil war, strike, rebellion, revolution, industrial dispute, terrorist activity, infectious disease/ epidemic, travel restrictions, natural or nuclear disaster, fire, adverse weather conditions, technical or maintenance problems with transport, or other circumstances which amount to force majeure. For this reason, we strongly recommend that you purchase travel insurance and ensure such events are covered by your provider.
(g) If you need to cancel due to contracting COVID-19 or travel restrictions caused by COVID-19, we may be able to move you to an online training, transfer your money to future training, or refund your money.
(h) Other than what was described in 3(g), it is not possible at any stage to transfer your booking to another retreat, service, or individual.
4. Travel Arrangements
(a) All travel arrangements and costs are your responsibility. We are not liable to any consequences arising from delays, complications, or cancellations with any companies you have made arrangements with, or for any irregularities in your documentation required for travel. Transfers to/from the retreat are at your own cost unless otherwise specified.
5. Changes to Training
(a) It is very unlikely that we will have to make any changes to your training, but arrangements are made many months in advance and changes may have to be made. We reserve the right to, within reason, change any information advertised at any time, to include, but not be limited to, dates, times, timetable, location, curriculum, accommodation, teachers, and prices. We will advise you of any changes at the earliest possible date and aim to keep disruption to a minimum. If your accommodation has to be changed, we will do our utmost to provide accommodation of a similar rating. If a significant change becomes necessary, we will inform you as soon as reasonably possible.
6. Surcharges
(a) Unless stated otherwise, transportation costs to include, but not be limited to, flights, visa & travel document arrangements, COVID-19 testing, transfers, and taxis are not included in the price of the training. In the event these prices are displayed or discussed, they are an estimate only and we will not be liable for any differences to what was originally estimated.
7. Health and Insurance
(a) It is the attendees responsibility to inform the teacher of any injury/medical conditions when booking and before the start of every session. You should consult a doctor or physician before attending the training to ensure you are sufficiently fit and healthy to undertake yoga classes and any other activity that has been arranged.
(b) If you experience any injury or discomfort during any activity organized for you, you must stop immediately and advise the teacher(s) accordingly.
(c) Please advise us of any mental or physical health conditions and dietary requirements before you book. If you have health conditions and dietary requirements that may be affected by the activities offered on our training we reserve the right to advise you to desist and in the interests of your wellbeing, or others, we may decline your stay at our training.
(d) Whilst all measures are taken to ensure a high standard of health and safety, we may be situated in the countryside where the land is uneven and we shall not be responsible for any injuries caused by uneven terrain or obstacles.
(e) Should you be pregnant or are planning to be pregnant at the time of the retreat, please contact us to discuss before booking. Those who are 12 weeks pregnant and beyond should provide a letter from their health practitioner specifying that they are fit to travel and able to engage in the activities that we provide.
(f) Travel insurance is highly recommended. If you choose to buy insurance we require that your travel insurance covers the activity of this training as well as unexpected cancellation, sickness, losses, and all the usual risks. You should bring the policy with you in case of an emergency. We recommend all guests take up full travel insurance to cover medical expenses and personal belongings and should cover the type of physical exercise that will be undertaken. We hold no responsibility for illness, injury, death or loss, or damage to personal belongings at any time (as per the liability waiver in section 16), nor will any compensation be issued in such a case.
(g) We reserve the right to stop your participation in any activity, at any time, if we conclude that you are physically, mentally, or emotionally unable to do so.
8. Alcohol / Drugs Policy
(a) Guests should not practice yoga under the influence of alcohol, drugs, or both, and doing so will result in immediate dismissal from the session, retreat, or both, with no refund being issued.
(b) Guests must respect TMS partners and affiliates. If a guest requests drugs from local staff and retreat partners it will result in immediate dismissal from the retreat with no refund being issued.
9. Right to Refuse
(a) We reserve the right to dismiss or refuse entry to any session or the training at any time at the teacher’s discretion with no refund being issued, in the event of a breach of any of these terms and conditions, or disruptive behavior.
10. Privacy Policy
(a) We will not pass on your information to any third party or organization outside of TMS, without your permission. We respect your privacy.
(b) Any personal information that you provide to us will be used only for the service you requested. This information is used only for the administration of the site system and in the compilation of statistics used by us to assess the use of the site. This privacy policy does not cover the links within this site linking to other sites.
(c) We will use your details to inform you of updates about the retreat, and any future events.

11. Passport and Visa Requirements
(a) It is the responsibility of all guests, according to the type of passport you have, to check with the consulate where the application for a tourist visa is required. Since visa regulations and health requirements can change frequently especially with COVID-19, it is recommended that you check as soon as possible whether the application for tourist visas or health requirements is necessary. It is your responsibility to monitor all visa, health, and testing requirements for international and national travel. TMS is not responsible if you or another passenger is traveling without proper health documentation or the correct passport or visa. In this case, you should pay the costs of assistance to solve these problems. In addition, you must complete the full payment of your training, without receiving any refund or compensation from TMS.
12. Complaints
(a) If you have a problem during your retreat, please inform a member of our team immediately, who will endeavor to put things right. If your complaint cannot be resolved locally, you must advise us in writing on your return. Please note that we cannot guarantee the proportion of males/females in any group, nor be responsible for the individual behavior of any group member or other guest on your training.
13. No Liability for Possessions
(a) You will be given your own personal key to your room. It is your responsibility to ensure that your possessions are kept safe at all times. This includes hiring cars or other hired equipment. TMS is not responsible for any lost or stolen items.
14. Photography
I, for good and valuable consideration, the receipt of which is hereby acknowledged, hereby irrevocably authorize TMS partners, agents, or employees to use photographs of me and or my property and authorize her and her assignees, licensees, legal representatives, and transferees to use and publish (with or without my name) photographs, pictures, portraits or images in all forms and media and in all manners, including composite images or distorted representations, and the purposes of publicity, illustration, commercial art, advertising, publishing (including publishing in electronic form on CDs or internet websites), for any product or services, or other lawful uses as may be determined by the photographer or studio name here. I further waive all rights to review or approve any uses of the images, any written copy, or the finished product. I am of full legal age and have read and fully understand the terms of this release.
15. Legal Disclaimer
The information contained on this site is for general information on matters of interest. Given the changing nature of the rules, regulations, and laws and the chance of electronic communication, there may be omissions or misunderstandings on the information contained on this site. 16. Liability Waiver
(a) It is a requirement of anyone attending a training and/or classes with TMS to accept and abide by the following release of liability:
‘I understand that, while the utmost care is taken, neither the individual teachers, TMS nor the venue will be liable for any damage or injury resulting from my practice or use of the retreat center, nor any loss or damage to personal belongings. I understand that classes may be physically strenuous and I voluntarily participate in them with the knowledge that there is a risk of personal injury, property loss, or death. I recognize that it is my responsibility to notify the teacher of any illness or injury before the start of every yoga session and I will not perform any posture to the extent of strain or pain. I will notify the teacher before every class should I not want to be physically adjusted. I agree that neither I, my heirs, assigns or legal representatives will sue or make any other claims of any kind whatsoever against The Mindfulish School, their
teachers or members for any injury, property loss, or wrongful death, whether caused by negligence or otherwise.’
(b) The release of liability statement applies to the duration of the training and every yoga session or activity you participate in, whether in a group or private setting. If this statement is not accepted, your booking will be terminated, and all monies paid in advance will not be refunded.
